Electronic registration of stay third country nationals in Schengenarea

The European Parliament and the European Council have adopted a regulation to establish an Entry and Exit System (EES) which will register electronically the time and place of entry and exit of third-country nationals that are admitted for short stay to the territory of the Member States and which will calculate the duration of their authorised stay (Regulation (EU) 2017/2226). Third country nationals from countries that will need a Schengenvisa to enter the Schengenarea, and also visa exempted nationals, like USA nationals, will be electronically registered.

This new Entry and Exit System will replace the obligation of the EU Member States to stamp the passports of third-country nationals. The EES will apply to third-country nationals admitted for a short stay to the territory of the Member States. It will also apply to third-country nationals whose entry for a short stay has been refused.

The EES will automatically generate alerts to Member States when the authorised stay of the third country national has expired. An automated Schengenvisa day calculator shall calculate the overall limit of 90 days in any 180-day period.

The EES should, in particular, contribute to the identification of any person who does not fulfil or no longer fulfils the conditions of duration of the authorised stay on the territory of the Member States.

It is expected that the Entry and Exit System will become active at the end of 2020 or the beginning 2021.
